A trans-nonbinary-identifying suspect accused of shooting a US Border Patrol agent in New Hampshire earlier this year has been granted a medical furlough while receiving treatment for a traumatic brain injury.

Blu Zeke Daly was approved for release on medical furlough by US Magistrate Judge Andrew Johnston following a multi-day detention hearing. Daly faces federal charges, including one count of attempted murder of a federal officer and one count of assaulting a federal officer with a deadly weapon.

According to a report from the New Hampshire Union Leader, Daly will be permitted to receive treatment at a rehabilitation hospital that does not accept patients in the custody of state or federal authorities. Under the terms of the furlough, Daly’s mother, stepfather, and paternal grandparents will be allowed to visit.

Judge Landya McCafferty has also agreed to delay the trial by approximately nine months.

Daly’s attorneys argued that the case was time-sensitive, writing that “It has been delayed due to Ms. Daly’s custodial status. It continues to be delayed due to Ms. Daly’s custodial status.”

Judge Johnson previously ruled that Daly’s “evolving medical condition does not outweigh the factors favoring detention.”

“The circumstances raise serious questions about the defendant’s willingness/ability to comply with orders by law enforcement,” Johnstone wrote.

Last month, Daly pleaded not guilty from a hospital bed to charges stemming from the February shooting. A Border Patrol agent encountered Daly while on patrol in Stewartstown and initiated a traffic stop. Authorities say Daly initially provided a driver’s license before driving away, prompting the agent to follow from a distance.

Daly eventually drove to a Pittsburgh Port of Entry in New Hampshire and pulled up to a locked gate, where the agent activated his emergency lights, exited his vehicle, and approached Daly. Daly then pulled out a handgun and fired at the agent. The agent returned fire and struck Daly.
